Who gets the commission?

I showed this couple a house a month ago and wrote up the contract. The seller countered back $295k. They were only willing to offer $275k. Well, I just got an email with an amendment to a contract that was in a corporation's name. The amendment was to change the name to the wife's name of the couple I showed. It is the same house and they finally offered $295k but with a different Realtor. I have an email from the last time they and I spoke where they state "We believe you did everything you could do"

Do I have any recourse? :SM121: This house is closing in a couple days now. My brokers nor I knew that these people were involved or my Broker would have made sure I got the compensation.....but now that it's about to close, do I have anything to stand on?

I would SAY YOU DO! The one problem would be if your listing period had expired, but if you still where under contract I would contact the selling agents broker and present the case with the caveat that if it is not resolved to your mutual satisfaction that the board of realtors and the realtors commission will be called in to arbitrate the matter further.

that is what we are doing right now. With this new amendment to the contract...my brokers have to call the selling agent because "we need to get some facts straight so we know how to present it to the seller..by the way, who is Mrs. SoAndSo" then we have to make sure they can close still because this particular seller doesn't allow Assignments. Then if they can prove they can close, we will go to the selling agent and tell them they will have a Procuring Cause of Sale fight on their hands and then it could be at least 60 days before the commission will be paid.

Sounds like you're on your way to getting paid Sunraye, organize the facts and present them forcefully.
