View Full Version : Stopping bank from calling?

Question time!


I have a couple I have been working with on a loan remodification, the bank has been dragging their feet on this one but at the same time trying to collect on the arrears via phone calls. Even though I am listed as the primary contact party, I have receive not one call, This was fine in the beginning, but now this couples 80yr old mother is receiving these same calls to her house, she is getting quite stressed out about this. Is their anyway to put a stop to these phone calls? I have heard of writing a certified letter to stop creditors from any telephone correspondence, but am not sure the same goes for the bank? Any info/suggestions are always appreciated. Thanks!

Tim I would give your number to the folks that are getting these calls and tell them to tell the bank that they don't have anything to do with this but they can call you if they would like to speak with someone who does.

Write up a little script with the pat answer/reply and give it to grandma so she can parakeet the phrase to the caller along with your number, eventually these people are going to figure out that if they want some type of resolution that they are going to HAVE to call YOU!

Here's your script
"as provided by title 15 USC 1692c part B I'm authorizing you to contact Invstr73 with regards to this debt. His number is xxx-xxx-xxxx. Thank you for your understanding and cooperation"

Under 15 USC 1692c part C, the collector is required to cease communications with a consumer or have limited contact (by mail only) with a consumer if the consumer notifies the collector in writing.

Sample note "as prescribed by 15 USC 1692c part C, please limit contact with me to mail only."
She can even fax the written request to them.

These rules do not apply to the original creditor unless he uses any name other than his own which would indicate that a third person is collecting or attempting to collect such debts. [15 USC 1692a(6)].
