I've got a gal who just filed for Bankruptcy. I don't see our name on the list and she has paid her rent through November 30th.

I've never been through a Bankruptcy Case Before. Where do I stand.
She is on a MTM.

Hiya Ma,

Did you receive notification from the BK court? If so, it is against federal law for you to contact them about any debts owed. That said, it sounds like they are paid up, so your name wouldn't be listed as a creditor.

It would be walking a thin line, legally, to call (don't send a letter - evidence) and see how things are going, and if they intend to stay and pay.

Could just be that they have a mountain of credit card debt, or medical bills that they are being hounded for, and completely intend to keep paying you.

Let us know more, as you find more.

Another thought. The BK only relieves PAST debts, so rent is still due on the first. If they don't pay, you will have to go to court and ask the judge to lift the stay of eviction before you can file to have them removed.

I called her because I have a pretty good relationship with my Tenants and just asked what happened? I asked if she was okay and if everything was all right and she said yes. She had gotten into a car accident a couple of years ago and had to pay $75 a month. Guess they wanted her to pay more and so they took her to court again. She can't pay them so her attorney told her to file for Bankruptcy which she did. I asked her if she included me and if she was still planning to stay and she said yes. She'll have December's rent as well. So I'm happy and now she'll have more money. I told her I was glad she was okay.

I was figuring it was medical bills, but being hounded over a car wreck makes sense too. Your tenant really had no choice, and situations like hers is what BK is for.

Glad that you are meeting T&J. I intend to do the same during my springtime trip to Dallas. Radar said that they were very nice people, and that I would get along with them great.
