Should Investor record "Memorandum of Option" OR "Lease Option to Purchase Agreement (Pro Buyer)" in a lease option to purchase where Investor is the BUYER?

Assumptions:
1. "Memorandum of Option" and "Lease Option to Purchase Agreement (Pro Buyer)" are two separate documents.
2. "Lease Option to Purchase Agreement (Pro Buyer)" contains both the lease AND option to purchase in one document.

I've used a memorandum of option as well as an affidavit of interest, deending on the situation. I'm not sure, but this may vary a bit state to state. I'd ask someone experienced in your state, call your courthouse, or ask a local attorney.

Guessing though, I'd say the memorandum of option.
