i pretty much understand this concept but my question is about the recording of the option memorandum? the investor records the option with the original seller, but do you still record the t/b option with the investor? isn't it impossible to do both because the title is already "clouded"? :SM122:

If you are going to use this strategy, then you would only want to record the option with the title company one time. As an investor, you would record your option with the seller. This is to protect you from the the owner changing his/her mind and selling the property out from under you.
When the tenant/buyer is ready to close, you simply assign your option to the tenant/buyer.
