Okay, I went on Monday to court. The lawyer seemed to be stuttering a lot. I had a lot of evidence that the judge did not even ask for. I told him about the lawyer changing the locks on me after making this deal that I got the house back on July 21st The judge was/is going to accept that agreement I think! The judge gave me until September 17th to document all the damages and gave me permission to enter the house by any means possible if my key doesn't fit and to bring the local police with me. I did just that. Embarrassingly enough, the key did not fit in the front door BUT it fit into the back door! So the lawyer gave me a key back to what I thought was the front door because that is where his wife was trying out all of her keys until she found one that worked. I can only assume that she gave me the wrong key and that is why I thought he changed the locks. God I hope that isn't used against me! At least I didn't have to break in. It was almost as if I was on trial and not the defendant. The police officer that supposedly sen him purchasing a door lock on July 20th said he THOUGHT that was why the lawyer was at the store. So there goes that theory! The judge told me to subpeona the police officer. I guess he will determine the damages and rent due on September 17th. I just don't understand how he could make this agreement I made with the tenants on July 20th stick? I thought I had to legally evict tenants. Especially when this lawyer was crying about illegal eviction. That is why I decided to do this through the court system (Plus I thought he changed the locks on me) I guess a curbside agreement not in writing works now! Now the tenant is countersuing for storage fees, said some mumbo gumbo per quorem (sp?) legal term or something like that. I guess because I had a porch chair and a rug and odds and ends, soe supplies in the basement etc.. in there because I staged the house with a few things to make it look nice when I showed it to them two years ago. Geez, can't wait to get this over with! Any pointers? I have consulted with an attorney by the way and have an appointment with him August 31st. I just want to see if you all should think I should hire him or not. Thanks!
