View Full Version : Update...Evicting my lawyer tenant

Well, for those who know my situation with this lawyer tenant of mine, he has decided to file false accusations on me and file a $3,200 counter claim. He wants storage because I left a microwave, cart nd paint cans in the basement and said he contacted me numerous times to remove said items. LIE! NEVER has he contacted me regarding this crap! Double security, etc...

We had a dispute over the door locks I thought he changed after our 5 day rent agreement/possession date we made on the street corner in front of cops. Comes to find out, he gave me the wrong key for the wrong door. I testified that he changed the locks because I thought he had. It was the key to the BACK DOOR. I was a bit embarrassed. I didn't try the key in the back door because they tried this one in the front and it fit. How I got the wrong key when they took it off their keychain is beyond me.

The judge gave me a month to take pictures of damages, etc. Next hearing: Sept. 17th. I am scared that the judge might frown at the fact that I accused the tenants of changing the locks. It was a simple mistake. I didn't try the key in the back door because the key in question only fit the deadbolt and there is no deadbolt in back.

Confused yet? I guess according to my attorney that we can make a deal outside of putting it in writing since we both testified about it in court. I did not know that. We agreed that I would get possession back on July 21st and that is when they gave me the key. THEY DID NOT GIVE ME KEYS BACK BUT A KEY. Only to the back door. I figured that when that key didn't fit, I had better file for LEGAL eviction. They owe rent from July 15th through August 15th.

Why did I file for eviction even after making this possession deal with them in front of the house? Because this lawyer tenant's last word's to me were "I am sorry this all happened, BUT when someone wants to start a pissing game with me....." I cut him off by stating that I just want to do this amicably. I have this on videotape ( I didn't know I was taping the conversation at the time.) I felt threatened by that statement. I know this is long, Please forgive me. ANY POINTERS OR SUGGESTIONS? tHANKS!
