I was advised by a SC attorney (where I live and do business) that all of my leases should include this clause:

"THIS IS YOUR NOTICE: If you do not pay your rent within 5 days of the due date, Landlord may begin eviction proceedings. You will get no other notice as long as you live in this rental unit."

Supposedly, according to this attorney, this clause covers my butt in eviction court because it serves as my 5-day notice. I've never had to serve a 5-day notice anyway, but I thought this would be handy and helpful to others.

Sorry, I'm not sure if this is kosher in other states, but if it is, go ahead and use it, at no charge. :-)

I'm in Va and I have similar clause in my lease; however, I do serve 5-day pay rent in full or quit notices with hefty late and notice fees to allow payment and then I can file an eviction/UD on the 11th or 12th of the month....it does not hurt; however, I would not file a UD on just the lease clause in case judge did not like it. I always have my pay or quit notice in the file with me at trial.:SM039:

I am in SC also and have been using this clause for a long time . all I have to do is go to judge pay 40.00 and they start serving papers . its great usually if I do this once in a while people start paying ahead of time . something about a deputy knocking on your door at 6:30 am get the blood flowing.
